FAMILY LAW

The family law team at HOLLOWAY JENKINS includes an accredited specialist and other practitioners who have many years' experience in property and children’s issues. Our cases range from complex multi-million dollar property disputes and international child abduction/relocation cases, to finalising a consent arrangement with the agreement of both parties.

We deal with property disputes for married and defacto couples.  Irrespective of how large or small your asset pool might seem, attempting to reach an agreement without the right advice and understanding the principles of family law can result in your losing a once-only opportunity to get it right the first time.  You owe it to yourself to get good, practical advice about your entitlements and a likely range of outcomes.  This will assist you achieve a fairer division.

Significant amendments were made to the Family Law Act in July, 2006 which greatly affect parental responsibility and everything from the amount of time children spend with their separated parents to whether one parent may relocate after separation. 

Separating parents must have good advice early in their separation to ensure they take into account their joint responsibilities towards their children.  It is our experience that parents who are informed are generally able to make better decisions about their family responsibilities and therefore reduce the likelihood of needing to bring their dispute before a court.

RESIDENTIAL CONVEYANCING

When you are selling or buying your residential property, you should always obtain legal advice before signing a contract. The excitement and/or stress of your real estate deal can sometimes distract you from the seriousness of the commitment you are about to make.

If you are buying or selling your business, the contract of sale may be very complex. HOLLOWAY JENKINS can provide you with specific advice for your business transfer and assist with the preparation of contract through to completion of the transaction.

WILLS AND ESTATE PLANNING

Your Will gives you peace of mind. Knowing your assets are gifted to those you have chosen and that your estate will be administered by your choice of Executor is important.  We do not recommend ‘do-it-yourself’ Will kits as a simple mistake now could mean big problems (and cost to your estate) later.

 

As it is an important document, HOLLOWAY JENKINS will draft your Will to comply with legal requirements and give you advice on options.

 

We are able to store your Will in our safe custody facilities at no cost to you.  There is no obligation on your Executor to retain our firm after your death should they not wish to do so.

 

When you think about your estate planning you should also consider an Enduring Power of Attorney (“EPoA”) and/or an Advance Health Directive.  An EPoA allows you to appoint one or more persons to manage your financial and/or personal health matters either immediately (for financial matters) or a some time in the future (for example, upon your incapacity) and to limit those powers. A Health Directive gives you control to make decisions about your future health care.
